Negligence in Female Reproductive Care
The Law Office of Robert Cherofsky has successfully sued OB/GYN doctors for malpractice contributing to birth injuries, undiagnosed birth defects, infertility, or life-threatening medical conditions of the mother.
I have represented pregnant and non-pregnant women throughout New York City in holding obstetricians, gynecologists, OB/GYNs, radiologists and hospitals accountable for their negligence. Contact me today to determine if you have a viable case for damages.
OB/GYN Malpractice in Prenatal Care
The OB/GYN is responsible for the health of the mother and her developing fetus. It may constitute medical malpractice when physicians miss signs of trouble in routine prenatal exams and pregnancy screenings:
- Fetal distress
- Profound genetic defects
- Ectopic pregnancy
- Gestational diabetes or hypertension in the mother
- Incompetent cervix or other danger of premature birth
The doctor should closely monitor or order additional tests for women in certain high-risk categories (over 40, prior difficult births, racial/ethnic propensity to certain diseases).
Negligence in Labor, Delivery and Newborn Care
Doctors and nurses should anticipate certain obstetric complications and be vigilant for signs of distress in the baby or the mother. Serious birth injury can occur from negligence in late-stage pregnancy, labor and childbirth:
- No attempt to stave off pre-term labor or strengthen a premature baby's undeveloped lungs
- Failure to monitor fetal heart rate
- Ill-advised vaginal delivery
- Delayed C-section
- Improper delivery technique
- Negligent neonatal care, such as failure to treat hyperbilirubinemia (jaundice)
The mother may suffer injury from unchecked high blood pressure, errors in anesthesia or inducing labor, caesarean surgery or complications of abortion.
Gynecological Malpractice
I have also brought suit for failure to diagnose cancer or conditions of female reproductive organs that threaten the woman's health or lead to infertility or impaired reproductive capacity, such as:
- Cervical cancer, ovarian cancer, uterine cancer or breast cancer
- Sexually transmitted disease
- Pelvic inflammatory disease
- Cysts, endometriosis, urinary tract infections
